망중립성은 2005년 미국의 Madison River사건을 계기로 이슈화되었다. 미국의 지역 통신사업자 겸 ISP인 Madison River사가 Vonage사의 VoIP호를 차단한 사건이 발생하여 2005년 2월 FCC가 조사에 착수하였다. 그러자 Madison River사는 호차단을 철회하고 15,000달러의 벌금을 내기로 합의하였는데, 이러한 사실이 언론에 보도되면서 그 동안 우려의 대상으로만 논의되고 있었던 망중립성 문제가 마침내 현실화되었다. 이후 미국 FCC는 이용자의 선택권을 강조하는 기본입장을 정리하여 정책선언의 형태로 망중립성을 위한 4원칙을 발표하였다. 뿐만 아니라 미 의회에서도 2006년 통신법의 새로운 개정을 추진하면서 망중립성 관련 규제의 도입 여부가 주요 쟁점으로 등장하면서 다수의 법안이 제출되어 논의되고 있다. 이에 반해 EU국가들에서는 망중립성에 대한 논의가 미국에 비해 상대적으로 활발하게 이루어지지 않고 있는 상황이어서 이에 대해 정리한 관련 문헌을 접하기 또한 쉽지 않다. 그러나 EU 각국은 망중립성 논의의 중요성은 충분히 인식하고 있으며 미국 등에서의 논의 전개과정을 계속해서 주시하고 있는 바 현 시점에서 EU 주요국에서는 망중립성에 대한 어떠한 논의가 진행되고 있는가를 살펴볼 필요가 있다.
